South Pier Media Ltd – Standard Website Hosting Terms & Conditions

These Terms and Conditions (“Terms”) apply to the Standard Website Hosting service provided by South Pier Media Ltd (“South Pier Media”, “we”, “our”, “us”) to any client (“you”, “your”). By purchasing or continuing to use Standard Website Hosting, you agree to be bound by these Terms.

1. The Service

• Unlimited bandwidth*
• 10 GB NVMe SSD storage
• 2 GB LVE RAM
• 2 × vCPU
• Twice-daily backups
• SSL certificate
• Comprehensive security features
• Daily security scans
• Email support during business hours

Hosting is provided and managed by South Pier Media using reputable UK-based server infrastructure. Bandwidth is described as “unlimited” for normal business website use and may be restricted if usage is excessive or abusive.

2. Acceptable Use

Hosting is intended for your own business website and directly related content. It must not be used for unrelated file storage/sharing, bulk or mass email sending (over 500 recipients per send), illegal or malicious content, or any activity breaching applicable law or third-party rights. We may suspend services immediately if your site endangers security or performance.

3. Payment Options

3.1 General

Fees are payable in advance, either annually or monthly, per your selection at signup.

3.2 Payment by Bank Transfer (Full Payment)

• Annual fee payable by bank transfer on invoice.
• Service starts after cleared funds.
• Renews automatically each year unless cancelled under clause 9.

3.3 Instant Pay via GoCardless (One-Off Direct Debit)

• Annual fee collected once via GoCardless (Direct Debit).
• You authorise South Pier Media (via GoCardless) to collect the stated amount from your nominated bank account.
• Protected by the Direct Debit Guarantee (full and immediate refund from your bank in the event of error).

3.4 Monthly Direct Debit (Recurring)

• Monthly fee collected automatically via GoCardless under your Direct Debit mandate.
• Advance notice of each collection (normally three working days).
• Rolling monthly service until cancelled in accordance with clause 9.
• Fees may be adjusted from time to time (e.g., supplier costs, inflation) with at least 30 days’ written notice.
• You may cancel your mandate at any time via your bank; cancelling the mandate alone does not terminate this agreement (see clause 9).
• Protected by the Direct Debit Guarantee.

3.5 Late or Failed Payments

We may suspend hosting until overdue sums are paid. Repeated failures may result in termination. Reasonable administrative costs arising from failed or reversed payments may be recovered.

4. Renewal

Services renew automatically monthly or annually based on your plan. We will give at least 30 days’ notice of any price change before renewal. You may opt out by giving at least 14 days’ written notice before your next payment date.

5. Backups & Data

Twice-daily automated backups are included as a safeguard but full recovery cannot be guaranteed. You remain responsible for maintaining your own independent backups.

6. Security

Includes SSL, daily malware/vulnerability scans, and server-level firewalling. You must keep CMS core, themes, and plugins updated. We may temporarily disable access if your site is compromised or poses risk to others.

7. Support

Email support during UK business hours (09:00–17:00, Mon–Fri excluding public holidays) for server performance and availability. Content changes, bug fixes, or third-party plugin troubleshooting are out of scope and can be quoted separately.

8. Liability

We provide services with reasonable skill and care but do not guarantee uninterrupted uptime or absolute data security. We are not liable for indirect or consequential losses (including loss of business, revenue, or goodwill). Nothing limits liability for fraud, negligence causing death or personal injury, or any liability that cannot lawfully be excluded.

9. Cancellation & Termination

• You may cancel with 30 days’ written notice to dan@southpier.co.uk.
• Cancelling a Direct Debit mandate does not by itself terminate your hosting agreement; written notice is required.
• We may terminate immediately if you breach these Terms, payment fails or remains overdue, or termination is required by our infrastructure provider.
• On termination, you must migrate your site and data before service ends; backups and stored data may be permanently deleted thereafter.

10. Price Changes

We may adjust prices from time to time (e.g., supplier costs, inflation) with at least 30 days’ prior notice. If you do not accept a change, you may terminate with 30 days’ notice before it takes effect.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

Notes: *“Unlimited bandwidth” means no fixed cap for normal business website traffic. We reserve the right to restrict or suspend excessive or abusive usage that impacts server performance.
